Welcome to AWQATY, a service provided by Bytesy Innovations. By accessing our website and registering for an account, you agree to be bound by these Terms and Conditions. Please read them carefully.

Introduction

This document outlines the terms under which you may access and use the AWQATY platform, including all related services. Your continued use of the platform indicates your acceptance of these Terms and Conditions.

Definitions

• AWQATY : Our appointment management software developed and operated by Bytesy Innovations.
• Service Provider : Any individual or business that registers with AWQATY to manage appointments and related services.
• Users : Clients or customers who book appointments and services through the AWQATY platform.

Subscription, Fees, and Payment Terms

• Subscription & Billing
• Invoices are issued electronically at the beginning of each subscription period (typically annually).
• Service Providers must pay all fees within seven (7) days of invoice issuance to avoid service suspension.
• Fee Policy :
• All subscription fees are non-refundable, even in cases of cancellation or service suspension.
• Should you opt to add extra features (such as additional calendars or paid services), your subscription fee will be adjusted accordingly.
• Late Payment:
• Failure to pay fees within thirty (30) days may result in suspension or termination of services without prior notice.

AWQATY Payments and Transaction Fees

• Transaction Fees:
• KNET Transactions: A fee of 1 Kuwaiti Dinar plus 250 Fils per transaction.
• Card and Digital Wallet Transactions (VISA, MasterCard, Apple Pay, Google Pay): A fee of 1 Kuwaiti Dinar plus 2.75% of the transaction amount.
• Payment Transfers:
• KNET: Funds are transferred within two (2) business days.
• Other Payment Methods: Funds are transferred within seven (7) business days.
• Liability:
• AWQATY is not liable for any delays caused by third-party payment providers or banking institutions.

Responsibilities of Service Providers

As a Service Provider, you agree to:

• Use the AWQATY platform in compliance with all applicable laws and regulations.
• Keep your service information accurate and updated (including service descriptions, pricing, availability, and policies on cancellations or refunds).
• Resolve any disputes with your users in a professional and fair manner.
• Ensure timely payment of all applicable subscription and transaction fees, including any additional charges incurred due to late payments.

Responsibilities of AWQATY (Bytesy Innovations)

• We commit to :
• Platform Access: Provide continuous access to the platform, except during scheduled maintenance or unforeseen technical issues.
• Data Security: Safeguard your data and that of your users through appropriate security measures.
• Payment Facilitation: Process and transfer payments according to the schedules set forth above.

Duration and Cancellation

• Term : This Agreement remains effective for the duration of your subscription. Subscriptions automatically renew at the end of each term unless cancelled.
• Cancellation by Service Provider:
• You may cancel your subscription at any time by providing written notice.
• Fees for the current subscription period remain non-refundable.
• Cancellation by AWQATY :
• We reserve the right to suspend or terminate your subscription if fees are overdue by more than thirty (30) days, if you breach any terms of this Agreement, or if there is misuse of the platform.
• In such cases, you will be notified with a clear explanation, except when immediate termination is warranted due to a severe breach.

Privacy and Data Security

• We are committed to protecting your personal and business data in accordance with applicable data protection laws.
• You are responsible for maintaining the confidentiality of your login credentials and account information.

Limitation of Liability

• Exclusion of Indirect Damages :AWQATY shall not be liable for any indirect, consequential, special, or incidental damages (including, without limitation, loss of revenue due to platform downtime or delays in payment processing).
• Indemnification :You agree to indemnify and hold AWQATY harmless from any claims arising from your use of the platform.
• Force Majeure :AWQATY is not responsible for service interruptions due to scheduled maintenance, natural disasters, cyberattacks, or issues with external service providers.

Governing Law and Dispute Resolution

• Governing Law :This Agreement is governed by the laws of the State of Kuwait.
• Dispute Resolution:Any disputes shall first be attempted to be resolved amicably. Failing that, disputes will be submitted to the appropriate courts in Kuwait.

Entire Agreement

This document constitutes the complete and exclusive understanding between you and AWQATY regarding your use of the platform, superseding all prior agreements or understandings.

Modifications

AWQATY reserves the right to modify these Terms and Conditions at any time. We will notify you at least thirty (30) days prior to the implementation of any changes. Your continued use of the platform following the notice indicates your acceptance of the updated terms.

Acceptance of Terms

By registering for an account or using the AWQATY platform, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
